ORDINANCE NO. 85-8-2711
AN ORDINANCE AUTHORIZING THE CITY TREASURER TO EXECUTE A PERPETUAL CARE
AND MAINTENANCE TRUST FUND AGREEMENT WITH PEOPLES FIRST NATIONAL BANK AND TRUST
COMPANY FOR MAINTENANCE AND UPKEEP OF OAK GROVE CEMETERY
WHEREAS, the City of Paducah owns and operates Oak Grove Cemetery,
located in the City of Paducah, Kentucky; and
WHEREAS, the Kentucky Revised Statutes, Chapter 367, require all
cemeteries to establish an irrevocable trust fund for the general care,
maintenance and embellishment of cemeteries.
WHEREAS, the City is desirous of establishing an irrevocable trust fund
for the general care, maintenance and embellishment of the cemetery with an
independent institution.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The City Treasurer is hereby authorized to execute a
Perpetual Care and Maintenance Trust Fund Agreement with Peoples First National
Bank and Trust Company for maintenance and upkeep of Oak Grove Cemetery, a copy
of which is attached hereto and incorporated herein as if set out in full.
SECTION 2. In order to establish this fund as required by the 1984
Legislature, an emergency is hereby declared to exist and this ordinance will
become effective immediately after one reading.
