HomeMy WebLinkAbout85-2-2650243 ORDINANCE NO. 85-2-2650 AN ORDINANCE ESTABLISHING A LOCOMOTIVE RELOCATION TRUST FUND, ACCEPTING THE PROPOSAL OF NATURAL GRAPHICS LTD, REPRESENTING ARTIST STEVEN R. ESTES, TO DEPICT THE VINTAGE RAILROAD LOCOMOTIVE IN 300 LIMITED EDITION BLACK INK PRINTS OF THE LOCOMOTIVE, AND TO PAY NATURAL GRAPHICS LTD THE SUM OF $4,500.00, AND AUTHORIZING THE SALE OF SAID PRINTS FOR THE SUM OF $30.00, AND ACCEPTING OTHER CONTRIBUTIONS TO THE FUND WHEREAS, Illinois Central Railroad Company has given to the City a steam locomotive for a memorial; and WHEREAS, said memorial was on display in the City of Paducah; and WHEREAS, it has become necessary to relocate said locomotive memorial; and WHEREAS, Natural Graphics Ltd, representing artist Steven R. Estes, has proposed that said artist prepare 300 Limited Edition black ink prints to raise money for the relocation of said locomotive; and WHEREAS, it is the intent of the City to accept said proposal, to establish a relocation trust fund and establish the selling price of the prints. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY, AS FOLLOWS: SECTION 1. The City Treasurer is hereby authorized and directed to establish a Locomotive Relocation Trust Fund Account for receiving proceeds from the sale of prints as hereinafter set out and other donations for the purpose of relocating the locomotive memorial from its present site to the site at First and Broadway within the City of Paducah. SECTION 2. The City Manager is hereby authorized to enter into an agreement with Natural Graphics Ltd, a company representing artist Steven R. Estes, providing for the delivery of 300 Limited Edition black ink prints of the railroad locomotive and paying said Natural Graphics Ltd the sum of One Thousand ($1,000.00) Dollars upon the execution of this agreement and the sum of Three Thousand Five -Hundred ($3,500.00) Dollars no later than June 30, 1985. SECTION 3. Receipt of the prints, distribution and collection of monies for the prints, shall be the responsibility of Paul Moore, who shall turn all monies received by him over to the City Treasurer. SECTION 4. The City shall sell the prints for the sum of $30.00 each, with funds first being used to reimburse the City the amounts under the contract outlined above, and all other funds be placed by the City Treasurer in the Relocation Trust Fund herein created. SECTION 5. The City Treasurer is authorized to spend money from said trust fund on any and all expenses necessary for the relocation of said locomotive, upon approval of the City Manager. SECTION 6. Any funds remaining in said Relocation Trust Fund, after all relocation expenses are paid, shall be deposited and become part of the Locomotive Memorial Trust Fund set forth in Section 2-10 of the Code of Ordinances of the City of Paducah, Kentucky. SECTION 7. In order to implement the relocation program, and under time constraints to relocate said locomotive, an emergency is hereby declared to exist and this ordinance shall 244 be effective immediately upon passage by the Board of Commissioners with reading and prior to publication. However, said ordinance shall be published according to law.
