HomeMy WebLinkAbout08/18/70051 Proceedings of Board of Commissioners Settle claim West Ky (Poultry Co Sell grave Rushing Add Cosmopolitan Mortuary Sell grave Rushing Add jSledd Funeral (Home Receive, file and reject v bids on tire: City of Paducah August 18, 1970 A meeting of the Board of Commissioners of the City of Paducah, Kentucky, was convened at the usual and customary meeting place in the City Hall at Paducah, Kentucky, on the 18th day of August, 1970, at the hour of 7:30 P.M., local time, pursuant to adjournment from the Called Meeting held on Augu-st 11th, 1970, as shown by the minutes of said called meeting. Mayor Protem Rev. W. G. Harvey was in the Chair presiding, and upon call of the Roll, it was determined that the following members of the Board of Commissioners were present: H. E. Fisher, John Hornsby, Henry Puryear and Mayor Protem Rev. W. G. Harvey. The following were absent: Mayor Robert C. Cherry. It appearing that a quorum was present, the Mayor Protem called the meeting to order, and announced -that it had been properly convened for the transaction of business, acc-ording to law. - Commissioner Fisher offered motion, seconded by Commissioner Hornsby, that the claim of Gene Martin of West Kentucky'Poultry Company in the amount of $216.30 for damage to his truck caused by a collision with a City of Paducah truck operated by Frank Woodall on June 5, 1970, on North 8th Street, be allowed, and that the City Treasurer be authorized to pay.said amount after first obtaining a complete release. Adopted. on call ,of .the Roll, Yeas, Commissioners Fisher, Hornsby, •Puryearr- and Mayor Protem Harvey (4) . Commissioner Fisher offered motion, seconded by Commissioner Hornsby,.that the Board of Commissioners approve the sale by the City of _.Paducah `to .C6smopolita<n-_~Mortuary of the Southeast corner of Lot No. 404 in Block No. 6 of the Rushing Addition to Oak Grove Cemetery, and that the City Clerk be authorized to execute a deed of conveyance to said cemetery grave. Adopted on call of the Roll, Yeas, Commissioners Fisher, Hornsby, Puryear and Mayor Protem Harvey (4). Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that the Board of Commissioners approve the sale by the City of Paducah to Sledd Funeral Home of the Northwest corner of Lot No. 404 in Block No. 6 of the Rushing Addition to Oak Grove Cemetery, and that the City Clerk be authorized to execute a deed of conveyance to said cemetery grave. Adopted on call of the Roll, Yeas, Commissioners Fisher, Hornsby, Puryear and Mayor Protem Harvey (4). Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that the following bids for furnishing the City its requirement of tires for the period from August 1, 1970 to July 31, 1971, be received and filed: Good year Service Stores Firestone Stores B. No 95 Proceedings of -- _ _Board of � Commissioners City of Paducah- - August :18,.v,1970 Change lot numbers Commissioner Puryear offered motion, seconded by Commissioner Hornsby, as follows: Rushing Addition - No. 315 & No. 404 It appearing that Lot No. 315 and Lot No. 404 in Section 6 of the Rushing Addition to Oak Grove Cemetery are incorrect and should be reversed. Now therefore, I move that the City Engineer and the Cemetery Superintendent of the City of Paducah, Kentucky, be, and they are hereby, authorized and directed to change said Lot 315 to Lot 404, and to change said Lot 404 to Lot 315 on all plats and records. Motion of Planning Commissioner Puryear offered motion, seconded by Commissioner Hornsby, that the Commission- alley closing Cairo Rd. Board of Commissioners receive and file copy of the motion adopted by the Paducah 13th St, Beltline & Atkins Avenue Planning Commission on August 5, 1970, recommending that the alley lying between Cairo Road and North 13th Street and extending from Beltline Highway to Atkins Avenue not be closed. File contract Mayor Protem Harvey, offered motion, seconded by Commissioner Fisher, that the Oaklawn Code Enf. executed copy of the Contract between the City of Paducah and the United States of America, .Depamtment-of Housing and Urban Development, authorizing local approval for Section 312, Rehabilitation Loans for the Oaklawn Neighborhood Improvement Project, be received and filed, together with the letter of transmittal to City Manager, Larry E. Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that a resolution entitled "A RESOLUTION REQUESTING THE CITY MANAGER TO ADVERTISE FOR BIDS FOR THE PURCHASE OF ONE (1) new 1970 PANEL TRUCK FOR USE IN THE POLICE DEPARTMENT, AND PRESCRIBING THE CONDITIONS UPON WHICH SUCH PURCHASE SHALL BE MADE", be adopted. Adopted on call of the Roll, Yeas, Commissioners Fisher, Hornsby, Puryear and Mayor Protem Harvey (4) . The Mayor Protem reminded the members of the Board of Commissioners that upon the occasion of the called meeting which was called and held on August 11, 1970, the Board of Commissioners approved on its first reading the so-called "Series B and Series C Ordinance" authorizing for the benefit of Paducah Junior College (now known as Universit of Kentucky, Paducah Community College), the issuance of $412,000 "Consolidated Educational Buildings Revenue Bonds - Series B" and $350,000 "Consolidated Educational Buildings Revenue Bonds - Series C"; and that the called meeting of August 11 was adjourned to convene again at this time and place principally for the purpose of considering said Ordinance on its second reading. He also reminded the members of the Board that the Board had adopted a Resolution approving the "Notices of Sale" and other related sale documents, in order that the Notices might be published -in accordance with KRS Chapter 424 in anticipation of receiving bids for the purchase of these Bonds at public sale upon the occasion of the Board's regular meeting which is scheduled to take place on August 25, 1970. After full discussion Commissioner Puryear moved second reading and final adopti of the "Series B and Series C Ordinance" which was given first reading at the called meE of August 11, 1970, the same being identified by its title or caption as follows: AN ORDINANCE OF THE CITY OF PADUCAH, KENTUCKY, AUTHORIZING THE ISSUANCE'OF $412,000 CONSOLIDATED EDUCATIONAL BUILDINGS REVENUE BONDS, SERIES B, AND $350,000 CONSOLIDATED EDUCATIONAL BUILDINGS REVENUB BONDS, SERIES C, FOR THE BENEFIT OF PADUCAH JUNIOR COLLEGE (NOW KNOWN, AS UNIVERSITY OF KENTUCKY, PADUCAH COMMUNITY COLLEGE). The motion for second reading and final adoption of said Ordinance was seconded by Commissioner Hornsby. After further discussion, the Mayor Protem put the question, and upon call of the roll the vote thereon was recorded as follows: Voting "Aye": H. E. Fisher, John Hornsby, Henry Puryear and Mayor Protem Rev. W. G. Harvey. Voting "Nay": None. The Mayor Protem then declared that said Ordinance had been approved on second reading and finally adopted, signed the same in open session, caused it to be attested under seal by the City Clerk, directed that it be enrolled, and directed that a copy k" delivered by the City Clerk to the Paducah Sun -Democrat for publication at the earliest possible date, and declared that it would be in full force and effect as provided by lau 97 Proceed;ngs of Board of Commissioners QY of Paducah Auaust 18; 1970 The Mayor Protem then reminded the Commissioners that in the'case of the ordinanceswhich are required to be given first reading, and then to be held over in the office of the City Clerk for a period of seven days prior to second reading and final adoption, it is provided by law that such ordinances shall not become effective for ten days after second reading and' 'final adoption; but with a provision that such ordinances may become effective immediately in the event it is determined by the Board of Commissioners that an emergency exists which requires such immediate effectiveness. He stated that in the opinion of the Corporation Counsel and Bond Counsel, the "Series B and Series C Ordinance -"probably does not fall within the purview of the statute requiring two readings seven days apart, but that it had been recommended that said Ordinance, nevertheless, be treated in accordance with such statute in order that there might be no question about the proper adoption thereof. However, the Mayor Protem pointed out that a state of emergency may properly be said to exist, requiring that said Ordinance be made effective immediately, in that for more than a year financial conditions have been chaotic and unpredictable, interest rates have been extraordinarily high, the market now seems to have improved somewhat, at least'on a temporary basis,'and it is urgently recommended by =the --Fiscal Agent that these Bonds be sold on the market at an early date, and before too much opportunity is given for a reversal of the present favorable trend. He also stated that the local banks which have advanced money for construction purposes in anticipation of the sale of these Bonds have been most patient, and are entitled to be repaid at the earliest possible date. He asked what the pleasure of the Commissioners might be in this respect.l Thereupon Commissioner Puryear offered the following motion: In connection with the authorization and public offering of $412,000 "Consolidated Educational Buildings Revenye Bonds, Series B," and $350,000 "Consolidated Educational Buildings Revenue Bonds, Series C," for the benefit of Paducah Junior College (now known as University of Kentucky,Paducah Community College), the public health and safety requires that the so-called "Series B and Series C Ordinance" become effective immediately, I therefore move that an emergency be declared to exist and said ordinance shall become effective immediately upon its publication as required by law. The motion was seconded by Commissioner Hornsby. After full discussion the Mayor Proten put the question, and upon call of the roll the vote was recorded as follows: Voting "Aye": H. E. Fisher, John Hornsby, Henry Puryear and Mayor Protem Rev. W. G. Harvey. Voting "Nay": None. The Mayor Protem then declared that said motion had been duly adopted and was in full force and effect; and that by reason thereof the aforesaid "Series B and Series C Ordinance" would be effective immediately upon its publication, according to law. Mayor Protem Harvey offered motion, seconded by Commissioner Fisher, that an ordinance entitled "AN ORDINANCE CLOSING AN ALLEY IN THE BLOCK BOUNDED BY CAIRO ROAD, NORTH 13TH STREET, BELTLINE HIGHWAY AND ATKINS AVENUE IN THE CITY OF PADUCAH, KENTUCKY", be adopted. Adopted on call of the Roll, Yeas, Commissioners Fisher, Hornsby, uryear and Mayor Protem Harvey (4). Mayor Protem Harvey offered motion, seconded by Commissioner Fisher, that an ordinance entitled "AN.ORDINANCE AMENDING SECTION 2-47 OF THE CODE OF ORDINANCES CITY OF PADUCAH, KENTUCKY", be adopted.
