At a Regular Meeting of the Board of Commissioners held in the Commission Chamber
in the City Hall, Paducah, Kentucky, at 7:30 p.m., on February 24, 1970, Mayor Cherry
presided and upon call of the Roll the following answered to their names: Commissioner:
Fisher, Harvey, Hornsby, Puryear and Mayor Cherry (5).
Mayor Cherry offered motion , seconded by Commissioner Harvey, that the reading
of the Minutes for February 10, 1970 be waived and that the Minutes of said meeting
prepared by the City Clerk be approved as written. Adopted on call of the Roll, Yeas
Commissioners Fisher, Harvey, Hornsby, Puryear and Mayor Cherry (5).
Mayor Cherry made the following appointments: Subject to the approval of the
Board of Commissioners, I hereby appoint the following members to the Civic Beautifica-
tion Board for terms expiring July 5, 1970:

Commissioner Fisher offered motion, seconded by Commissioner Harvey, that the
Board of Commissioners approve the action of Mayor Robert C. Cherry appointing members
to the Civic Beautification Board for terms expiring July 5, 1970. Adopted on call of
the Roll, Yeas, Commissioners Fisher, Harvey, Hornsby, Puryear and Mayor Cherry (5).
t Mayor Cherry made the following appointment: The term of office of Dr. Norman A.
Parrott as a member of the Urban Renewal and Community Development Agency expires on
February 23, 1970. I therefore, subject to the approval of the Board of Commissioners,
appoint Thomas E. Lambert to serve as a member of said Board for a term of four (4) year
so that said board shall be composed of the following members:
Joseph H. Freeland whose term expires February 23, 1971
Gresham'Hougland whose term expires February -23., 1972 -
Noble Clark whose term expires February 23, 1972
Rev. H. Joseph Franklin whose term expires February 23, 1973
Thomas E. Lambert whose term expires February 23, 1974
Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that the
Board of Commissioners approve the action of Mayor Robert C. Cherry, appointing Thomas
E. Lambert as a member of the Urban Renewal and Community Development Agency of the Cite
of Paducah. Adopted on call of the Roll, Yeas, Commissioners Fisher, Harvey, Hornsby,
Puryear and Mayor Cherry (5).
Mayor Cherry made the following appointment: It appearing that the term of office
of Ernest Mitchell as a member of the Electric Plant Board of the City of Paducah,
Kentucky, expired on February 6, 1970. Subject to the approval of the Board of
Commissioners, I hereby appoint R. L. Brockman as a member of said Board for a four (4)
year term expiring February 6, 1974.

Commissioner Harvey offered motion, seconded by Commissioner Fisher, that the
Board of Commissioners approve the action of Mayor Robert C. Cherry appointing R. L.
Brockman as a member of the Electric Plant Board for a term expiring February 6, 1974.
Adopted on call of the Roll, Yeas, Commissioners Fisher, Harvey, Hornsby, Puryear and'
Mayor Cherry (5) .
Commissioner Fisher offered motion, seconded by Commissioner Harvey, that the
report of the Paducah Planning Commission denying the application of Al Rea to rezone
certain property in the City of Paducah, which application was heard by the Paducah
Planning Commission on February 18, 1970, be received, approved and filed. Adopted on
call of the Roll, Yeas, Commissioners Fisher, Harvey, Hornsby, Puryear and Mayor
Cherry (5) .
Commissioner Fisher offered motion, seconded by Commissioner Harvey, that the
claim of Charles A. Hansen in the smount of $66.57 for damages to his 1968 Mustang cau
by falling gravel from a city dump truck operated by Chester Garner in the vicinity of
Lone Oak Road on January 26, 1970, be allowed, and that the City Treasurer be authorized
to pay same after first obtaining a complete and final release. Adopted on call of the
Roll, Yeas, Commissioners Fisher, Harvey, Hornsby, Puryear, and Mayor Cherry (5).
Commissioner Fisher offered motion, seconded by Commissioner Harvey, that a copy
of the Audit Report prepared by Schuette & Taylor for the year ended December 31, 1969,
be received and filed. Adopted on call of the Roll, Yeas, Commissioners Fisher, Harve
Hornsby, Puryear and Mayor Cherry (5) .
Commissioner Harvey offered motion, seconded by Commissioner Fisher, that the Boa
of Commissioners approve the sale by the City of Paducah to Charles Wheeler of Grave No.
9, Lot 295 in Section 19 of Oak Grove Cemetery for the sum of $100.00. I further move
that the City Clerk be authorized to execute a deed of conveyance to said cemetery grave

Mayor Cherry (5).
S., . Commissioner Harvey offered motion, seconded by Commissioner Fisher, that the
following documents from the Paducah Board of Education concerning the 1970 tax rate fo
school purposes, be received and filed:
1. Letter regarding General Fund Levy and Resolution
2. Resolution and Certification of General Fund Levy
3. Resolution and Certification for Special Building Fund Levy
4. Four copies of General Budget
5. Copy of Certified Assessment from Department of Revenue
6. Copy of Tax Rate Calculation from Department of Education

Heating Company, Inc. for constructing a gravity sewer crossing under the Lone Oak Road
at Poplar Street and Julia Street, be received and filed. Adopted on call of the Roll,

Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that the
executed copy of the contract between Nelsen Concrete Products, Inc, and the City, for
the purchase of concrete pipe and accessories, be received and filed. Adopted on call
of the Roll, Yeas, Commissioners Fisher, Harvey, Hornsby, Puryear and Mayor Cherry (5).
Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that the
Certificate of Insurance issued by Allstate Insurance Company to Frank Melber, Jr.
for a term expiring on July 26, 1970, be received, approved and filed. Adopted on

Commissioner Hornsby offered motion, seconded by Commissioner Puryear, as follows
It appearing that J. Y: O'Bannon, Cemetery Superintendent, was 65 years of age on
February 19, 1970 and subject to compulsory retirement under the terms and provisions
of an ordinance adopted by the Board of Commissioners on January 2, 1968, and it
appearing from said ordinance that such employment may be extended from time to time
by motion adopted by said Board for periods not exceeding eighteen (18) months durati
I now therefore move that -the employment of J. Y. O'Bannon, Cemetery Superintendent, be
extended for a period of eighteen (18) months past said date of February 19, 1970.

Board of Commissioners approve the sale by the City of Paducah to Mundy Funeral Home
of the northeast corner of Lot No. 328 in Black No. 6 of the Rushing Addition to Oak
Grove Cemetery, and that the City Clerk be authorized to execute a deed of conveyance
to said cemetery grave. Adopted on call of the Roll, Yeas, Commissioners Fisher,
Harvey, Hornsby,Puryear and Mayor Cherry (5).

Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that
an ordinance entitled "AN ORDINANCE ACCEPTING THE BID OF ALLAN RHODES, INC. FOR SALE
TO THE CITY OF FOUR (4) NEW 1970 FORD F600 TRUCKS FOR USE IN THE STREET DEPARTMENT,
AND AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR SUCH PURCHASE", be
introduced and remain on file for at least one (1) week for public inspection in the
completed form in which it shall be put upon its final passage. Adopted on call of
the Roll, Yeas, Commissioners Fisher, Harvey, Hornsby, Puryear and Mayor Cherry (5).

CIVIL SERVICE ORDINANCE', WHICH WAS ADOPTED BY THE BOARD OF COMMISSIONERS ON DECEMBER
2, 1947, AND LAST AMENDED ON AUGUST 26, 1969", be adopted. Adopted on call of the
Roll, Yeas, Commissioners Fisher, Harvey, Hornsby, Puryear and Mayor Cherry (5).

ordinance entitled "AN ORDINANCE ACCEPTING THE BID OF BAKER OLDSMOBILE, INC. FOR SALE
TO THE CITY OF SEVEN NEW 1970 OLDSMOBILE DELTA 88 TOWN SEDANS FOR USE IN THE POLICE
DEPARTMENT OF THE CITY OF PADUCAH,'AND PRESCRIBING THE TERMS AND CONDITIONS UPON WHICH
PURCHASE SHALL BE MADE", be adopted. Adopted on call of the Roll, Yeas,

Mayor Cherry offered motion, seconded by Commissioner Puryear, that an ordinance
entitled "AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT ON BEHALF OF
THE CITY OF PADUCAH, KENTUCKY, WITH PERRY WALLACE AND WOODROW GILLETTE, JR. FOR THE
OPERATION OF A BOAT DOCK AND MARINA FACILITIES ON THE RIVER FRONT, AND SETTING FORTH
THE TERMS AND CONDITIONS OF SUCH AGREEMENT", be adopted. Adopted on call of the
