Proceedings of Board of Commissioners City of Paducah December 20. 1977
At a Called meeting of the Board of Commissioners held in the Commissioner Chamber
in the City Hall, Paducah, Kentucky, at 4:30 p.m. on December 20, 1977, Mayor Murphy pre-
sided and upon call of the Roll the following answered to their names: Commissioners Brumley,
Grumley, Hornsby, Puryear and Mayor Murphy (5) .
Mayor Murphy offered motion, seconded by Commissioner Hornsby, that the
executed copies of the Notice of Called Meeting to be held on December 20, 1977 at 4:30 p.m.,
be received and filed. Adopted on call of the Roll, Yeas, Commissioners Brumley, Grumley,
Hornsby, Puryear and Mayor Murphy (5) .
Mayor Murphy offered motion, seconded by Commissioner Hornsby, that the reading
of the Minutes for December 13, 1977 be waived and that the Minutes of said meeting pre-
pared by the City Clerk be approved as written. Adopted on call of the Roll, Yeas, Com-
missioners Brumley, Grumley, Hornsby, Puryear and Mayor Murphy (5) .
Commissioner Hornsby offered motion, seconded by Commissioner .Puryear, that the
following bids be received and filed:
1. For tables and chairs, etc. for use at the Civic Center building:

Commissioner Puryear offered motion, seconded by Commissioner . Hornsby,
that the following documents be received and filed:
1, Report of,. the_Paducah Planning Commission rezoning a portion of Broadway
between 7th Street and 3rd Street, from B-2, Downtown Business Zone to
B -2-T, Downtown Business Townlift Zone.
2. Report. of .the Paducah Planning Commission rezoning a portion of Broadway
between 3rd Street and an alley east of North 2nd Street from B-3, General
Business Zone to B -2-T, Downtown Business Townlift Zone.
3. Certificate of Insurance and Performance ,Bond covering Wahl's Excavating
Company, issued by The Western Rivers Agency, Ins . , for a period
expiring August 11, 1978.

WHEREAS, Kentucky Revised Statutes permit the adoption of resolutions by
reference to a summary thereof;
I therefore move that a resolution authorizing the City Manager to advertise for
sale to the highest responsible bidder, one Barber -Green asphalt mixer and one Litter -Getter
leaf machine, and as appended in full hereto be adopted according to law. Adopted on call
of the Roll, Yeas, Commissioners Brumley, Grumley, Hornsby, Puryear and Mayor Murphy (5) .
Commissioner Brumley offered motion, seconded by Commissioner Grumley, as
follows:
WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by
reference to a summary thereof;
I therefore move that an ordinance approving the final report of the Paducah Planning
Commission respecting the rezoning of property located on Broadway between 7th Street and
3rd Street, and amending the Paducah Zoning Ordinance - 1976, so as to effect such rezoning,
and as appended in full hereto be adopted according to law. Adopted on call of the Roll,
Yeas, Commissioners Brumley, Grumley, Hornsby, Puryear and Mayor Murphy (5) .

Company, for the sum of $3,749.00, for sale to the City of a hydraulic impactor for use by
the Street Department, and as appended in full hereto be adopted according to law. Adopted
on call of the Roll; Yeas, Commissioners Brumley, Grumley, Hornsby, Puryear and Mayor
Murphy (5) .

I therefore move that an ordinance authorizing the payment of $3,099.50 to
Smith Sanitation Equipment, Inc . , for the purchase of parts to repair a city Dempster
dumpmaster, ratifying the action of the City Manager, and as appended in full hereto, be
adopted according to law; this being the second and final reading. Adopted on call of the

Commissioner Puryear offered motion, seconded by Commissioner Hornsby, as
WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by

and complete settlement of all claims arising out of a lawsuit entitled, "Oscar Carter, Jr . , v.
City of Paducah", and as appended in full hereto be adopted according to law; this being the

Grumley, Hornsby, Puryear and Mayor Murphy (5) .
Commissioner Puryear offered motion, seconded by Commissioner Hornsby, as follows:
WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by

I therefore move that an ordinance accepting the bid of K & K Office Equipment
for sale to the City of tables and chairs for use at the Jaycee Civic Center building, for the
sum of $2,618.26, and as appended in full hereto, be adopted according to law. Adopted on
call of the Roll, Yeas, Commissioners Brumley, Grumley, Hornsby, Puryear and Mayor
Murphy (5) .
Mayor Murphy offered motion, seconded by Commissioner Hornsby, as follows:
WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by
reference to a summary thereof;
I therefore move that an ordinance authorizing the City Manager and City Treasurer
to pay the' sum of $1,223.37 to Jasper Engines for additional parts and repairs to the City's
International 250-C tractor used on the Refuse Department Landfill, and as appended in full
hereto, be adopted according, to law; this _being the second and final reading. Adopted on
call of the Roll, Yeas, Commissioners .Brumley, Grumley, Hornsby, Puryear Y'y and Mayor Murp
Commissioner Hornsby offered motion, seconded by Commissioner
Puryear, as follows:
WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances

I therefore move that an ordinance accepting the bid of Rudd -Woodall
Ford -Mercury, Inc . , for sale to the City of Two 1978 Ford Model CT -8000 cabs and
chassis, for the sum of $28,090.00 each, to be used by the Refuse Department, and as
appended in full hereto, be adopted according to law; this being the second and
final reading. Adopted on call of the Roll, Yeas, Commissioners Brumley, Grumley,
Hornsby, Puryear and Mayor Murphy (5) .

The next business to come before the Board was the hearing of charges preferred
by Leon Dodge, Chief of the Paducah Fire Department, against Reid Kennedy, Jr., a member
of said department.
The case for the complainant was presented by Corporation Counsel, W. David
Denton, and the defendant, Reid Kennedy, Jr. was represented by Attorney Charles Saladino .
Charges against Reid Kennedy, Jr. Both the complainant and defendant were present in person.
Attorneys W. David Denton and Charles Saladino distributed copies of the doctors'
reports as to the physical condition of Reid Kennedy; also his alleged injury while on duty.
The
complainant called as
witnesses the
following person who gave testimony under
oath: Fire
Chief Leon Dodge and
Assistant Fire
Chief, Les Cope.
Mayor Murphy called a five minute recess at 6: 10 p.m. until 6:15 p.m., whereupon
the Board reconvened and motion was made by Commissioner Hornsby, seconded by Com-
missioner Puryear that the charges preferred against Reid Kennedy be dismissed. Commissioners
Hornsby and Puryear voted "Yea", Commissioners Brumley, Grumley and Mayor Murphy voted
"Nay". LOST.
Assistant Chief Cope was returned to witness stand and exhibited a log sheet
which was introduced as evidence, showing Firefighter Kennedy reported for work on
October 18, 1977 and when he was told he would not be allowed to sleep downstairs, went
home. The defendant then testified in his own behalf.
Mayor Murphy asked if any member desired to make a motion to retire to executive
session for the purpose of discussing the status of Mr. Kennedy. No motion was forthcoming.
After further discussion, Commissioner Brumley offered motion, seconded by
Commissioner Hornsby, that the charges preferred against Reid ' Kennedy, Jr . , be dismissed.
Adopted on. call of. the Roll, Yeas, Commissioners Brumley, Hornsby, Puryear (3) , Com-
missioner Grumley and Mayor Murphy voted "Nay".
Upon motion the meeting adjourned at 8: 05 p.m.
