At a regular meeting of the Board of Commissioners held in the Commission Chamber
in the City Hall, Paducah, Kentucky, at 7:'30 p.m. on October 11, 1977, Mayor Pro -tem
Brumley presided and upon call of the Roll the following answered to their names: Com-
missioners Grumley, Hornsby, Puryear and Mayor Pro -tem Brumley. Mayor Murphy was
absent (1) .
Mayor Pro -tem Brumley offered motion, seconded by Commissioner .Hornsby, that
the reading of the minutes for September 27, 1977 be waived and that the Minutes of said
meeting prepared by the City Clerk be approved as written. Adopted on call of the Roll,
Yeas, Commissioners Grumley, Hornsby, Puryear and Mayor Pro -tem Murphy (4) .
Commissioner Grumley offered motion, seconded by Commissioner Hornsby, that
the Board of Commissioners approve the sale by the City of Paducah of the following cemetery
lots and that the City Clerk be authorized to execute a deed of conveyance to said cemetery
graves:
1. Norman Malone of Lot 296 E-1, Section 19, Oak Grove Cemetery,
for the sum of $125.00, (Receipt No. 17929) .
2. Charles Wheeler of Lot 292 D-2, Section 19, Oak Grove Cemetery,
for the sum of $125.00, (Receipt No. 17928) .
3. Cosmopolitan Mortuary for Addie Kane of the northwest corner of
Lot 362, Block 6, Rushing Addition, for the sum of $100.00
(Receipt No. 17934) .

Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that
upon the recommendation of the City _Manager, I move that the following personnel
changes be made:
1. The following applicant candidates in the Paducah Fire Department,
having satisfactorily completed a training program and a probationary
period of 120 days as of September 30, 1977, be .appointed firefighters
in said department, at a base hourly rate of $2.68 per hour, retro-
active to. September 26, 1977:
Danny B. Johnson, at 6:30 a.m.
Wardelle G. Harvey, Jr . , at 6:31 a.m.
Bobby Z. Atkinson, at 6:32 a.m.
2. The following be employed, as part-time employees in the Parks &
Recreation Department, retoractive to October 3, 1977:
Denise Colson, baton instructor, $7.00 per session
David E. Mitchell, assistant gymnastics instructor, $3.50 per hour
Kelly Norman, assistant gymnastics instructor, $2.50 per hour.
3. Ronald D. Baker, laborer in the Street Department, be placed under
Civil Service, effective October 11, 1977.
4. Richard Myrick, collector in the Refuse Department, be placed under
Civil Service, effective October 18, 1977.
5. The hourly wage of Pauline W. Holt, part-time clerk -stenographer,
Selective Traffic Enforcement Program, Police Department, be changed
from $4.00 to $4.50 per hour, retroactive to October 3, 1977.

6. Charles White, laborer in the Cemetery Department, be terminated,

retroactive to October 4, 1977.

Commissioner Hornsby offered motion, seconded by Commissioner Puryear, as follows:
WHEREAS, the Board of Civil Service Commissioners, having duly heard the
charges brought against William P. Tolley, sewer maintenance man in the Street Department, and
WHEREAS, the Board of Civil Service Commissioners, after due and deliberate con-
sideration of the charges, and after thoroughly discussing and considering all testimony
presented, and
WHEREAS, the decision of the Board of Civil Service Commissioners was to terminate
William P. Tolley, effective September 30, 1977, and
WHEREAS, the findings of fact are recorded in the Minutes of the Board of Civil
Service Commissioners under the date of September 30, 1977,
I now, therefore, move that William P. Tolley, sewer maintenance man in the
Street Department, be terminated retroactive to September 30, 1977. Adopted on call of the
Roll, Yeas, Commissioners Grumley, Hornsby, Puryear and Mayor Pro -tem Brumley (4) .
Commissioner Puryear offered motion, seconded by Commissioner Hornsby, that
the following executed contracts be received and filed:
1. Between the City and Business Equipment and Supplies, for
two automated filing and retrieval systems for use by the
Police Department.
2. Between the City and B. T. Brooks & Son, Inc . , for the
construction of restroom facilities and reporting stand
In Noble Park.
3. Between the City and Southern States Asphalt Company, Inc . ,
:for. the City's requirement of asphalt for the year -.1977.
4. Between the City and Hannin Roofing & Sheet Metal Company,
Inc., for roofing repairs to the Fire Department Maintenance
Garage and the City Hall building; together with a certificate
of insurance issued by Liberty Mutual Insurance Company.

Commissioner Puryear offered motion, seconded by Commissioner Hornsby, that
the following documents be received and filed:
1. Report of the Electric Plant Board, dated September 28, 1977,
pertaining to its schedule of rates and charges.
2. Report of the Paducah Water Works for the month of September,
.1977.
3. A copy of the Budget, prepared by James C. Tidwell, City Manager,
for the period from July 1, 1977 through June 30, 1978.
4. A copy of the audit report of the Paducah Power System as of
June 30, 1977, prepared by Allen & Barnett, Certified Public
Accountants.

Commissioner Grumley offered motion, seconded by Commissioner Hornsby, as follows:
WHEREAS, Kentucky Revised Statutes permit the adoption of resolutions by reference
to a summary thereof;
I therefore move that a resolution requesting the City Manager to advertise for bids
for the purchase of one van type vehicle to be used as a patrol wagon for the Paducah Police
Department, and as appended in full hereto, be adopted according to law. Adopted on call
of the Roll, Yeas, Commissioners Grumley, Hornsby, Puryear and Mayor Pro -tem Brumley (4) .
Commissioner Puryear offered motion, seconded by Commissioner Hornsby, as follows:
WHEREAS, Kentucky Revised Statutes permit the adoption of resolutions by reference
to a summary thereof;
I therefore move that a resolution requesting the City Manager to advertise for
miscellaneous improvements to the Boys' Club of Paducah, Inc., and as appended in full
hereto, be adopted according to law. Adopted on call of the Roll, Yeas, Commissioners Grumley

Commissioner Grumley offered motion, seconded by Commissioner Hornsby, as follows:
WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by reference
to a summary thereof;
I therefore move that an ordinance amending Section 10-61 "Civil Service" of the
Code of Ordinances, creating the position of clerk -typist in the Fire Marshall's Office and as
appended in full hereto, be adopted according to law. Adopted on call of the Roll, Yeas,
Commissioners Grumley, Hornsby, and Puryear (3); Mayor Pro -tem Brumley voted "NO" (1) .
Commissioner Hornsby offered motion, seconded by Commissioner Puryear, as follows:
WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by reference
to a summary thereof;
I therefore move that an ordinance amending sub -section (a) and creating sub-
section (i) of Section 12-19 "Number, rank and salaries of Members" of Article II "Fire
Department", creating the position of alarm room technician in the Fire Department at a
salary of $743.00 per month, and as appended in full hereto, be adopted according to law.

Commissioner Puryear offered motion, seconded by Commissioner Hornsby, as follows:
WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by reference
to a summary thereof;
I therefore move that an ordinance accepting the, offer of Henry L. Lane to purchase
the interest of the City in Lot 27 Block 2 of Thurman, Hughes, Herzog and Bethel Addition,
for the sum of $500.00 and as appended in full hereto, be adopted according to law. Adopted
on call of the Roll, Yeas, Commissioners Grumley, Hornsby, Puryear and Mayor Pro -tem
Brumley (4) .
Commissioner Puryear offered motion, seconded by Commissioner Hornsby, as follows:
WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by reference

I therefore move that. an ordinance authorizing the City Manager to enter into an
agreement with Lawrence Hammet, et al, providing for the construction of a private sewer
line within the city limits and authorizing the city to accept said sewer line as part of its
sewer system? and as appended in full hereto, be adopted according to law. Adopted on
call of the Roll, Yeas, Commissioners Grumley, Hornsby, Puryear and Mayor Pro -tem Brumley (4) .

Mayor Pro -tem Brumley offered motion, seconded by Commissioner Puryear as
WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by
reference to a summary thereof;
I therefore move that an ordinance accepting the proposal of Allen & Barnett,
Certified Public Accountants for auditing the accounts of the Community Development Block
Grant Program for the sum of $2,500.00, covering the. period October 1, 1976 through
September 30, 1977, be adopted according to law; this being the second and final reading.

WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by reference
to a summary thereof;
I therefore move that an ordinance amending an ordinance, relating to promotions
in the Paducah Fire Department by requiring lieutenant applicants to have served for not less
than two years as relief drivers, and as appended in full hereto, be adopted according to
law. Adopted on call of the Roll, Yeas, Commissioners Grumley, Hornsby, Puryear and
Mayor Pro -tem Brumley (4) .

The next business to come before the Board was the hearing of the grievance
filed by Local 1586, wherein Harry Wright and Ronnie Moore, equipment operators in the
Refuse Department and currently working on the landfill, recently had their hours -of work
changed from 6: 30 a.m. to 3: 00 p.m. to 8: 00 a.m. to 5: 00 p . m ; which deleted their
one and one-half hours of overtime daily and which amounted to approximately $50.00 per
week per employee. The relief these two employees sought was that they be paid for
one and one-half hours of overtime for each work day since the date of the change through
today, because of the violation of the contract by management in not notifying the Union
this change would be taking place, and only giving the men involved one day's notice of
the change in working hours.
Mayor Pro -tem Brumley outlined the two problems as follows:
1. City failed to recognize Union by not notifying the Executive Board of the
change in working hours; and
2. Whether the City acted in violation of the contract in changing the working
hours of the two employees.
James Shaw, a foreman in the Refuse Department, stated there was work for
the men when they started work at 6: 30 a.m. , because the front-end loader truck started
work at 4: 00 a.m., and it was already unloaded ready for the men when they reported at
6: 30 a.m.
Mr. Tidwell stated he did not know when the practice of the overtime started, but that
state law requires the City to cover all refuse daily, therefore the operators must work
until 5: 00 p.m. Only by working until 5: 00 p.m. can this be properly accomplished.
Commissioner Puryear offered motion, seconded by Commissioner Grumley, that
Grievance No. 1 be denied. Adopted on call of the Roll, Yeas, Commissioners Grumley,
Hornsby, Puryear and Mayor Pro -tem Brumley (4) .
Mayor Pro -tem Brumley offered motion, seconded by Commissioner Puryear, that
Grievance No. 2 be denied. Adopted on call of the Roll, Yeas, Commissioners Grumley,
Hornsby, Puryear and Mayor Pro -tem Brumley (4) .
Commissioner Puryear offered motion, seconded by Commissioner Hornsby,
that the Board retire to executive session to discuss the upcoming retirement and/or
extension for the City's Public Works Director, who will reach retirement age next month.

Upon conclusion of the executive session, the Board reconvened in the Commission
Chamber, whereupon Mayor Pro -tem Brumley announded there was no further business.
